During the period of lockdown and partial closure of hospitality businesses one thing remains clear, responsibilities under the Health and Safety at Work Act still apply and duty holders must be taking reasonably practicable steps to control risk from legionella throughout this time.  Duty holders implicated in an outbreak of Legionnaires’ disease resulting from actions taken for COVID-19 precautions are not likely to have any exemption from prosecution.

The result of building closures will result in vastly reduced water usage within premises, increasing the risk of legionella and other water-borne bacteria surviving and proliferating within a building’s water systems. Building owners/managers need to take action to reduce this risk. This guidance details the action required within premises to safely manage water systems throughout this period.
